Terms of Service

These Terms of Service ("Terms") govern your use of HoursNest (the "Service"), operated by Byway Souvenirs ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms.

1. The Service

HoursNest helps clinical students (SLP, ABA, OT, PT, counseling and related disciplines) log supervised practice hours and track progress toward program requirements.

2. Eligibility and Account

You must be of legal age in your jurisdiction or have authority to bind the organization you represent. You are responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.

3. Acceptable Use

You must not misuse the Service. In particular, you must not:

  • Use the Service for any unlawful, fraudulent, or deceptive purpose;
  • Send spam or infringe intellectual-property or privacy rights of others;
  • Interfere with the security of the Service, including probing, scanning, scraping, or introducing malware;
  • Reverse engineer, resell, or circumvent any technical limits.

4. Intellectual Property

The Service, including its software, design, branding, and documentation, is owned by Byway Souvenirs and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. Content you submit remains yours; you grant us a limited license to host and process it solely to provide the Service.

5. Payments, Billing, and Subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. See also our Refund Policy.

Subscriptions renew automatically at the end of each billing period (monthly or yearly) until canceled. You can cancel any time from your account; access continues until the end of the current period.

6. Service Level

We work to keep the Service reliable but do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. The Service is not a substitute for professional clinical or legal judgment.

7. Suspension and Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, we will provide a reasonable period to export your data before deletion.

8. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law.

9. Indemnity

You agree to indemnify Byway Souvenirs against claims arising from content you submit, your unlawful use of the Service, or your breach of these Terms.

10. Changes

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use after the effective date constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Byway Souvenirs is established, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction.
